Website Design Terms & Conditions
Definitions:
The Client : The company or individual requesting the service of 121website.
121website: Designer / site owner & employees.
By using 121website for their services, you confirm that you are in agreement with and bound by the terms and conditions below.
While every endeavour will be made to ensure that the website and any coding are free of errors, 121website cannot accept responsibility for any losses incurred due to malfunction.
The website, graphics and any programming code remain the property of 121website until all outstanding accounts are paid in full.
Any scripts, cgi applications, php scripts, or software written by 121website remain the copyright of 121website and may only be commercially reproduced or resold with the permission of 121website.
121website cannot take responsibility for any copyright infringements caused by materials submitted by the client. 121website reserve the right to refuse any material of a copyrighted nature both for website design and print design unless adequate proof is given of permission to use such material. Websites found to be in breach of copyright if hosted with 121website will be removed without notice and will remain so until the copyright infringement has been dealt with. It is not until the client rectifies the copyright problem will the website be re instated.
121website will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client.
121website will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.
A deposit of 40% is required with any standard project before any design work will be carried out.. If the client is unhappy with the work or the service as a whole then a refund will be given but the time spent by 121website on the project will be deducted from this refund. This will be calculated at £20 per hour.
Hosting is offered for 12 months with a website.This is offered as a free service and as such can be terminated by 121website at any point. If 121website terminates the client hosting the client has the right to request a copy of the website on a cd rom to allow the client to move their website to a new host. After the 12 month period the client can re-host the website for a further 12 month period with 121website if required. The cost of hosting for the period is £40 per 12 months - this includes support. This support covers problems with the website or problems with email only. Any updates / changes/ new pages etc that are required will need to be paid for - this is charged at £20 per hour. If the website has been altered in any way by a third party then 121website will not be obliged to offer any support for the website. Any payments over due will result in the website being suspended until the payment is received. The client is not required to host their website with 121website and may take their website to a different host. On moving a website to a different host other than 121website all forms of support are cancelled.
Domain names are purchased for the client on designing a website. Either a .co.uk / .com / .net / .biz can be chosen if available. The domain is for 12 months for .com / .net / .biz and 2 years for a .co.uk domain. The domains are purchased in the clients name and it is the clients responsibility to renew the domain after the time stated above. 121website will renew the domain on behalf of the client if required. This will be charged at £15 per domain renewal. If a domain is not renewed it will expire and 121website will not be liable for any costs to recover the domain name.
Email accounts are offered with a website. This is offered as a free service and as such can be terminated by 121website at any point. 121website will not be liable for any costs incurred, compensation or loss of earnings due to problems with sending and receiving emails.
No adult websites, gambling websites or print material that will cause offence will be either created or hosted on 121website servers.
Once a website or printed material has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this. Non payment may result in legal action being taken.
Websites will be shown to the client over the internet and once a final agreement to design is agreed upon and carried out the final payment will be due. On completed payment the website will be delivered via the internet to the domain name for the website. At this point the website becomes the property of the client .
Whilst 121website offers hosting to host websites, no guarantees can be made as to the availability or interruption of this service. Every endeavour is made by 121website to offer reliable quality UK hosting of websites but 121website cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.
Privacy: 121website does not store any credit card details online or offline. Any information requested for instance name and addresses of clients is for contact information and setting up of domains only. This information is never shared with any third party. IP addresses are monitored - this is for company research only.
Anyone who experiences a problem with their service provided by 121website should raise the matter directly by email and clearly outlining the grounds for complaint.
121website will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.
